NOM-051 New Guidelines for labelling Requirements of F&B in Mexico

Starting 01 October 2020, Mexico is implementing a new labelling standard for all pre-packaged food and non-alcoholic beverages, an amendment to the regulation known as the NOM-051. Read here how to be prepared.

Starting 01 October 2020, Mexico is implementing a new labelling standard for all pre-packaged food and non-alcoholic beverages, an amendment to the regulation known as the NOM-051. This Official Mexican Standard (NOM for its abbreviation in Spanish) is developed by the Secretary of Economy in an effort to better inform Mexican consumers and benefit public health. Here are the implications for Dutch products.

Why the NOM-051?

Currently, nutritional information is displayed on all packaging based on the equivalent of a single portion. The controversy lies in the fact that the size of each portion is determined by the manufacturer, instead of a standardized measure. The Mexican government argues that this practice makes it difficult for consumers to interpret and compare nutritional information hence make well-informed decisions.

The modification seeks to help consumers easily identify food products that contain elements that can have negative health effects when consumed in excess, such as sugars,  saturated fats, trans fats, sodium, among others specified in the NOM-051.

 

What are the main changes?

  • A warning text is displayed on the front of each package through same-sized octagonal shapes with nutritional values
  • All nutritional information is based on 100-gram servings
  • The NOM-051 applies to all pre-packaged food products and non-alcoholic beverages sold within the Mexican territory. Both national and foreign products must meet the requirements
  • It is no longer permitted to use attractive images on packaging for products aimed at children. All images of cartoons, characters, animations, celebrities, sportsmen, pets, and interactive elements such QR codes are banned under the new regulations.


How can I prepare for implementation?

The regulations will come in effect on 01 October 2020. Several major industry players have requested a postponement of the date of implementation to remove additional pressure on the food industry amid the Covid-19 health crisis and allow time to reduce current stocks. Therefore, a 6-month adaption period has been granted until 31 March 2021.

Nonetheless, the octagonal nutritional information based on 100-gram servings must be in place on 01 October 2020. Companies are allowed to update current nutritional information by using stickers that cover the outdated information to comply to the new regulations.

The timeline for implementation:

  •  01 October 2020. First phase

Frontal labeling system (precautionary stamps and warning phrases)

  •  01 April 2021. 

Specifications, product designation, ingredients, NOM logo, nutricionial information, energy calculations 

  • 01 October 2023. Second phase

Updated nutritional profile required

  • 01 October 2025. Third phase

The calculation and evaluation of the complementary nutritional information will be carried out fully according to sections 4.5.3 of the NOM-051
